Proposed Fencing Amendment Local Law 2025
The public comment period has now closed. All feedback received will be analysed and the Fencing Amendment Local Law 2025 presented to Council for consideration later this year.
The City of South Perth is seeking public comment on a proposed Fencing Amendment Local Law 2025.
At its meeting held 25 June 2024, Council approved advertising the proposed Fencing Local Law 2024. After the advertising period closed, Council approved the making of the Fencing Local Law 2024, at its 22 October 2024 meeting.
The Fencing Local Law 2024 was then provided to the Joint Standing Committee on Delegated Legislation (JSCDL) on 28 November 2024 for their review. The JSCDL is a joint committee of the Parliament of Western Australia, delegated by Parliament, to scrutinise subsidiary legislation. The City was subsequently advised that a number of errors in the Fencing local law 2024 require amending.
What are the proposed changes to the local law?
The Fencing Amendment Local Law 2025 will amend the following:
1. Within one year, amend the local law as follows:
In clause 2.11(2)(a) and Schedule 1, item 9, replace ‘AS/NZS3016:1994’ with AS/NZS3016:2002’.
In Schedule 1, item 11, delete the reference to ‘(4).’
In Schedule 1, item 14, replace the clause reference with ‘2.13(1)(c)(i) or (ii).’
Make all consequential amendments arising from the above amendments.
2. Not enforce the local law to the contrary before it is amended in accordance with undertaking 1.
In addition the City is to advise on our website how the public can access (free of charge) Australian/New Zealand Standards adopted by this local law.
These amendments do not make any fundamental changes to the local law, they will however ensure that the local law is written in a consistent manner and easy to read for members of the public.

It should be noted that the changes being made to the local law are under the direction of the Joint Standing Committee on Delegated Legislation (JSCDL) which is a committee of the Parliament of Western Australia, which reviews all delegated legislation such as local laws on behalf of the Parliament. The JSCDL has the power to direct local governments to make necessary changes to local laws to ensure the local law is:
Within power;
Has no unintended effect on any person’s existing rights or interests;
Provides an effective mechanism for the review of administrative decisions; and
Contains only matter that is appropriate for subsidiary legislations
While your feedback is sought and valued, the City is very limited in its ability to change the proposed Fencing Amendment Local Law 2025, as directed by the JSCDL.
