The City seeks public comments on draft Scheme Amendment No. 58 to Town Planning Scheme No. 6 (the Scheme), relating to the land use definitions for ‘Liquor Store (Large)’, ‘Tavern’, ‘Hotel’ and Shop, as defined in Schedule 1 of the Scheme text.
In February 2016, the Minister for Planning approved Amendment 50 to the Scheme. This amendment introduced new definitions into Schedule 1 of the Scheme including the ‘Liquor Store (Large)’ and ‘Liquor Store (Small).
The intent of this amendment was to prohibit land from being used as a ‘Liquor Store (Large)’ in most zones under the Scheme because the City recognised that large format liquor stores potentially have a greater negative impact on amenity due to their size. The only zone where such a use was considered appropriate and not prohibited is the ‘District Centre Commercial’ zone.
It has recently come to the City’s attention that it is possible for a liquor store to be the subject of a tavern licence as opposed to a liquor store licence, and that it is possible to extend the existing tavern licence to cover an increase in the floor area of any existing ancillary, small liquor store the subject of a tavern licence. Consequently, a ‘loophole’ exists whereby a large format liquor store that is the subject of a Tavern licence (or perhaps a Hotel licence) may be approved as a ‘tavern’ (or perhaps a hotel) in zones where such a use would otherwise be prohibited.
The purpose of the amendment is to rectify this issue via further amendments to the definitions of Liquor Store (Large), Tavern, Hotel and Shop. The modifications will ensure that large format liquor stores are only capable of approval in appropriate zones.
Amendment No. 58 is now available for comment. The feedback period closed at 5pm, Tuesday 6 February 2018.
