Draft Scheme Amendment 57 - Canning Highway (East)

The Minister for Planning has approved Amendment 57 to the City of South Perth Town Planning Scheme 6.

Amendment 57 applies to land along either side and close to Canning Highway generally between the boundary with the Town of Victoria Park and Elizabeth Street and Arundel Street.

The amendment was endorsed by the City in December 2018 and has since been awaiting final approval from the State Government. Amendment 57 proposed increases in density coding throughout the area and would allow buildings between four to six storeys. For certain properties near to Canning Highway, additional building height and plot ratio was available under the amendment when a range of community benefits were provided.

The Minister made a number of modifications to the amendment endorsed by the City including:

  • Removal of provisions relating to bonus height. As a consequence, requirements to provide a range of community benefits in return for the bonus height were also removed
  • Increases to density codes for properties that were previously permitted bonus height
  • Alignment with the recently updated R-Codes, resulting in various changes to building setbacks.

The Minister's modifications do not allow any building within the precinct to exceed the City’s endorsed maximum height of six storeys.


Background 

Following a series of studies, community consultation and the preparation of a detailed character study report (Kensington/South Perth – Character Study Report), the City prepared a draft amendment to Town Planning Scheme No. 6 and an associated draft local planning policy.

The draft amendment and policy were considered by Council at its meeting of 26 June 2018, where Council agreed to commence formal public advertising on the proposals.

The draft amendment proposes to:

  • Create a new precinct, ‘Precinct 16: Canning Highway (East)’ that applies to Place 1 and Place 2 of the Kensington/South Perth - Character Study Report (refer to map below)
  • Apply development provisions relating to height, plot ratio, setbacks, building design and vehicle access for all new comprehensive development within the new precinct
  • Create a new special control area for land fronting Canning Highway at the eastern end of the new precinct to resolve vehicular access issues.

The draft Local Planning Policy (P351.16) provides further guidance on the development provisions contained in the draft amendment. Matters covered in the draft policy include how setback/building separation areas should be used, design quality and climate sensitive design.
